Welcome to SparkFast! These Terms of Service ("Terms") govern your use of the SparkFast mobile application (the "App") and our promotional website at www.sparkfast.app (the "Website"). Please read these Terms carefully before using our services.
By creating an account or using our App, you agree to be bound by these Terms.
1. IMPORTANT MEDICAL DISCLAIMER
SparkFast is not a medical service and does not provide medical advice. The information within the App, including the SPARK Chart, refeed protocols, motivational messages, and any other content, is provided for informational and educational purposes only.
- The App is not intended to be a substitute for professional medical advice, diagnosis, or treatment.
- Always seek the advice of your doctor or another qualified health provider with any questions you may have regarding a medical condition or before starting any new health regimen, including fasting.
- Never disregard professional medical advice or delay in seeking it because of something you have read or seen in the SparkFast app.
- The SPARK Chart and other features provide theoretical estimations based on general averages and are not a measure of your personal biomarkers. Individual results will vary.
2. User Accounts
- Eligibility: You must be at least 18 years old to create an account and use SparkFast.
- Account Creation: To use the App, you must register for an account, providing your name and email address, and create a password. You agree to provide accurate and complete information.
- Account Responsibility: You are responsible for all activity that occurs under your account and for keeping your password secure.
3. Subscriptions and Payments
- Paid Service: SparkFast is a subscription-based service. Access to the App's features requires a valid, active subscription.
- Billing: Subscriptions are managed and billed through the Apple App Store or Google Play Store. You can choose between a monthly or yearly plan. Payment will be charged to your App Store or Play Store account at confirmation of purchase.
- Automatic Renewal: Your subscription will automatically renew at the end of each term unless you cancel it. You can manage and cancel your subscription at any time through your App Store or Play Store account settings.
- Restoring Purchases: If you get a new device, you can use the "Restore Purchase" feature to regain access to your active subscription.
4. User Content
- Your Content: You may choose to upload personal information to the App, including health data, notes, and full-body progress photos ("User Content"). You retain all ownership rights to your User Content.
- License to Us: By uploading User Content, you grant us a limited license to store, display, and process that content for the sole purpose of providing the App's services back to you (e.g., showing you your progress photos or displaying your health data in charts).
- Responsibility: You are solely responsible for the User Content you upload. You agree not to upload any content that is unlawful, harmful, or infringes on the rights of others.
5. Intellectual Property
All content and technology associated with the App and Website, including the SparkFast name, logo, the SPARK Chart, and the underlying software, are the exclusive property of [Your Company Name] and its licensors. You may not copy, modify, or use them without our express permission.
